It sure is a sexy issue but it’s important to recognize two things

FIRST, That Ms. Burke told her story to the Jefferson City Police to make her boyfriend John Diehl mad. If you look at the report Diehl even questions her and says he doesn’t believe the story ... It sure seems odd that she didn’t file a report in KC if she was bothered by LeVota. Well I guess it’s not odd because if she would have filed it in KC, LeVota would be able to respond.

SECOND, more importantly, it is clear she made it up and on page 12 of the report she admits it TWICE.

“Burke stated while trying to tell him what happened she made up stories.” AND “Burke stated as she spoke with Diehl when started to make things up.”

Everyone seems to be glossing over the fact she admitted to lying and just focusing on the lie about LeVota that was included. Take a close look at the report!!

Here's an excerpt where Ms. Burke Mentions Mr. Levota

"Brittany Burke stated she was in Kansas City, MO and met two friends... A third person was with them identified as Phil Levota the brother of Senator Paul Levota. (The two friends) ended up leaving early after a couple of beers. Paul stayed and Burke stated her intuition told her she should leave. Burke stated all she does is work and never goes out so she stayed and had another drink. Burke stated they ended up going to another bar. Burke stated Phil kept trying to get her to be "touchy." Burke stated he was married but it didn't matter, because she wasn't interested in him. Phil then gave her a ride back to the hotel. The entire time back Burke stated Phil kept trying to get her to touch him. While dropping her off she tried to get out of the car but he did something to keep the door from opening . . . Burke stated she told Diehl this story while he was traveling in Europe. Burke stated Diehl was angry and wanted to harm Phil to stick up for her.

"Burke instructed him not to because it was her word against his and they had been drinking. Burke stated there are also rumor's about her sleeping with different people. Burke stated as a female in politics people are always clawing at her. Diehl was displeased that she was willing to let this go.

"Burke stated this prior incident is what she felt had him so angry when she showed up not remembering anything."

With so many news stories floating around Missouri about this incident, we decided to straighten things out by going straight to the source of the local part of the controversy . . .

STATEMENT BY PHIL LEVOTA REGARDING BRITTANY BURKE


On April 9, 2015, Brittany Burke made a claim of a possible sexual assault in Jefferson City (where I was not involved in whatsoever). After a thorough investigation by the Jefferson City Police Department, that claim was ruled unfounded but in that report she included a fabricated story about another unrelated incident in Kansas City that allegedly happened weeks before.
No charges were brought in the Jefferson City case because law enforcement found that the claim was false and that Ms. Burke admitted she had been less than truthful in her statements. But as far as the allegations she included in her statement that involved me, Ms Burke never made a report with any city where the fabricated story about me supposedly happened. If you read the police report carefully, Ms. Burke admits that the allegations against me were false but some have missed that in the 21 page report.

I want to state definitively that any allegations of wrongdoing regarding me are false and complete lies. I have been in contact with Ms. Burke’s attorney in relation to this false allegation but it seems that Ms. Burke’s interest in trying to stop future stories about her outweighs her choice to do the right thing and go on the record that her claim against me was a lie. Ms. Burke even recently called me to ask me not to make a statement because she is in fear that my telling the truth might create more interest in the media doing more stories about her life in the past two years. She stated she would not issue a statement admitting she lied because that also might open up new interest in stories about her. It is sad when someone chooses not to do the right thing for selfish reasons.

For the record, the only relationship I ever had with Ms. Burke was a professional one as her lawyer in one instance of handling a speeding ticket for her and nothing else. We have never had any sort of relationship outside of that nor have I ever pursued one. As a matter of fact, I have avoided her in Jefferson City because of the drama surrounding her.

I have read the Jefferson City report in its entirety and unfortunately the officer even states that Ms. Burke’s unstable mental state, her alcohol abuse, and her use of prescription drugs led her to state false things that happened in Jefferson City about me and other things. After their investigation, she finally agreed that in the Jefferson City incident she simply had too much to drink and ended up at the Speaker of the House’s apartment in Jefferson City. I was not in town nor named in that incident but the Jefferson City Police investigated and found that Ms. Burke had lied then.

Ms. Burke and Mr. Diehl’s intimate relationship has been admitted to and documented in the past few months. From the police report, it shows the relationship had ended but Ms. Burke went to Diehl’s apartment quite intoxicated. When Diehl ended the relationship, Ms. Burke told him a fabricated story about me to make Diehl jealous. Burke never intended on pursuing the false allegations with another police department because they were untrue. And Mr. Diehl even questioned her about the claims against me by asking why she didn’t go to the police. Several people close to Ms. Burke have conveyed to me that in those months she was seemingly unstable and under a tremendous amount of stress.

Ms. Burke always struck me as a good person and I am sorry for the issues she was dealing with then but it does not excuse her for falsely accusing another. The story about me was untrue and my name was callously used as a weapon to try to hurt her former boyfriend. I honestly believe that Ms. Burke never realized others would see or hear her false allegations against me and she was uninformed of police report procedures, but regardless of that her false story was included in the police report and made available to the public.

For those of you that are reading this saying this statement is being mean to a “potential victim,” please remember that Ms. Burke made these allegations against me in a Jefferson City report for something that she said happened in Kansas City but did not file anything in Kansas City. My name is being published as doing something wrong without any ability on my part to defend the lies about me.

Again, I want to state that all of the allegations against me are false. I have never been contacted by any law enforcement agency whatsoever related to this lie because it is false. As a former prosecutor and lawyer, I conduct myself professionally and to have my character questioned from fabricated attacks disgusts me and I will review my position in relation to defamation litigation for all parties involved or anyone furthering this false accusation.
