TKC NOTE: Recently, this social media message was sent my way from a Kansas City Area victim of Domestic Abuse. The lady at the center of this tragic situation felt that it was important to share her story in order to warn other women of the danger that confronts them. Check it:

Jackson County Domestic Abuse Testimony

On average, more than 3 women are murdered by their husbands or boyfriends in this country every DAY. Why? Because despite all the advocacy and laws spouting protection, the truth is when you are a victim of domestic abuse, the justice system and the law are NOT on your side. Every time I was beaten by my husband the police would show up and act like I was a 'problem' for them. The last incident, one even told me "there are people dying out there and I have to come and babysit your marital problems." Yes, that's right. Thank you Kansas City Police Officer for demonstrating clearly just how you view domestic abuse.

Today my protection order against my abusive ex husband was removed because he hired a ruthless lawyer. Because he paid big bucks I was denied my basic right of protection. At the court appearance for the restraining order, A JACKSON COUNTY JUDGE had the trial immediately, did not ask or offer that I get council even when I asked if I should (this was wrong on his account, as I was told by legal counsel after the trial), allowed my abusive ex's lawyer to verbally accost me and treat me like the criminal putting ME on trial, and I was not allowed to testify fully, to present evidence, nor did he allow my 2 witnesses to testify. He made a judgement without listening to the evidence, and he even told me the history of abuse does not count, only the incident the day before I filed for a protection order counts. What?!!

This is why women in this country are murdered so frequently by the people that are supposed to take care of them. Because in truth, it's so easy for them to do it. Why are our judges not held accountable when they make bad decisions? What harm would have been done to provide me with an order of protection against a man in which I have much evidence he had abused me for years? Who are the watchers out there to question what this judge did (and others like him). Shame on our judicial system, our media, and our society that continues to not keep our mothers, sisters, and daughters safe.

  3. I'm very sorry for what the writer has gone through. I wish she would name some names, though! "A JACKSON COUNTY JUDGE"... which one? I would love to know the name of the judge, the attorney, the prosecutor, etc.

  8. By law the woman who claims to be abused need not show anything except that she FEELS like she needs a 10 day temporary order or protection to have it granted.

    The woman here showed up to a hearing for a PERMANENT restraining order without counsel and felt shocked that she was asked to testify at her own hearing. Having a protection order can result in loss of job, eventual loss of custody of children, or loss of a security clearance.

    I would consider it to be completely reasonable that a person faced with such total scarlet-letter labeling that a protective order brings to be able to ask questions of their accuser in court and their accuser be required to present relevant evidence to support their need to obtain a protective order.

  11. Regarding the comment of "quit going back to him!!" - I am the victim that wrote to Tony. I have been separated from this man for several years. I haven't "gone back to him" in any way. He stalks me, harasses me, and terrorizes me.

    Because I have 3 children and receive no financial support from him and I was unemployed when I left him, I did not have money to pay for a lawyer which requires thousands of dollars in retainer fees up front. Legal Aid does not take on divorce cases. Because I don't have a money surplus, I was not able to buy the protection that I need with legal council.

    According to police, because we are legally still married he can come into whatever residence I reside, he can take the children whenever he wants. Whenever I contact the police for help - unless I am needing to be hospitalized they do not write any police reports stating there is not enough evidence. After I report that he tried to run over me with his car in front of my 5 year old son, a Sgt. at the South KC Police Dept told me that if he had tried to run over me with his car I would be in the hospital, and because that didn't happen there wasn't enough evidence to support my claim.

    Yes the judge is Kevin Harrell.

  12. I brought evidence and two witnesses and was not allowed to submit them.

    I was not shocked about testifying, I was prepared to testify. I was shocked that every time I opened my mouth the lawyer yelled objection before I formed a sentence - even the judge called him out on that.

    I was shocked that when I asked about having my lawyer for the trial I was told they will proceed.

    I was shocked that even though there is a plethora of evidence that he has been abusive for years, because I didn't have a snakey google-eyed lawyer that makes his living taking money from slimey people and turning the victim into the criminal, my right to be protected was overlooked.

    I was shocked that although this was a call for protection, the defendant and his lawyer turned it into a custody battle, which never should have been the case. Custody was not called into play, it was not why we were there.

    I was shocked that the lawyer and defendant were allowed to make biased and unverifiable claims yet I was unable to counter, question, or ask for proof.

    Why is our judicial system concerned about an abuser keeping his job but not concerned about the safety of an abused woman and children? This is what is wrong with our culture. This mentality is a sickness. This is why so many women DAILY are murdered by their husbands and boyfriends. Because the system is rigged to protect the criminal and leaves the victim exposed and vulnerable.

Not only was she ready to testify she had pics of the abuse she didn't get to share , AND two witnesses the judge didn't let us come in and testify to what we had seen with our own eyes ... GET this lets add more to the story .. she was at my apt , he came over and was abusing her in the parking lot . My neighbors screamed at him to stop. Then my spouse came out and yelled at him turned to come get the phone and call the cops . Then her abuser ran to him and started hitting HIM . My neighbor pulled her abuser off my spouse and escorted him to his car , where all my neighbors where yelling at her abuser and then he jumped into his car and left. The police where where called took his name .This man has anger issues, and It frightens me to the core not only did he get away with what hes done now , but there are children involved ...ever stop to think what type of person goes to far ?? Probably the ones who get away with what they do in the first place . I am disgusted with what happened and it sends him a message beat your spouse hit people do as you please .

  21. The UMKC Child and Family Services clinic takes as many of these cases on as they can. You should try to contact them.

    Most family law attorneys are quite reasonable too so don't write it off that all of them are going to expect thousands of dollars upfront. They will expect to be paid for services rendered though.

  22. While the judge is given great latitude in granting or denying these Protection Orders the decision can be appealed. Reasons such as what this person claims happened at the hearing to make it unfair can be brought up.

  23. The reason why protection orders are important is because that is the only thing that will cause the Police to take action when domestic abuse is happening. Without a restraining order, if an abuser is harassing or terrorizing the abused, unless he has beat her to hospitalization, the police consider it 'arguing' and that is a civil matter. With a restraining order - he can't come near her, call her, call her family or friends, etc.. So it DOES do some good. It makes the police do their job.

While he and his registered nurse wife lived in Independence, in a home valued at $160,000 several years ago he put his two daughters in Border Star Montesorri school, a KCMSD public school so he could get FREE preschool! They also said they once had a debate at their church about abortion and he said if a woman was raped the RAPIST should have a say in whether or not the rape victim have an abortion. That should tell you a lot about Kevin Harrell.

  30. To the women who originally started this, three things:

    First, I feel for you. The legal system at large is hard on people without means. A paralegal at a much lower cost could help you navigate the system much more cheaply and stand up against a judge and lawyer. Paralegals are not allowed to do this. It is much like having a nurse practitioner taking care of basic medicine and the doctors taking care of the complicated side.

    Second, move to Johnson County. If a man looks at you wrong, the police will take him to jail and you will get a victim's advocate.

    If you can't afford a move and you are in real danger the there are shelters that you can go to. You may have to up root and give up what you have but if you aren't safe what does anything else matter? If the court refuses to protect you the shelter will. Go to the shelter, let him know you are there. If comes around the shelter will have him arrested for trespassing at the very least. That will build a criminal record that you can use and most shelters have lawyers that can help.

    Not great options I admit but it seems Jackson Count and Johnson County are on opposite ends. In Jackson County not so long ago a women was brutally date raped in Jackson County. The rapist got a sweetheart deal for a rapist and the victim was not consulted about the plea deal.

    Tony also had a post on this blog about a guy who thought he was getting shafted by the prosecute anything money machine in Johnson County.

  33. I am the victim of domestic violence and he has lied, drugged me. I've been dripping with blood due to anal rapes, he has committed so many felonies you can't count them.
    He has now put some machines in/outside my home that make me sick, and other things that are harmful. To move doesn't matter as they are remotely controlled. He uses GPS and I have never gotten away from him. Does he do the usual things, no, he knows the law. Does he have a girl friend that helps, yes. Have they drugged and disfigured me, yes, did they get caught, no, I was drugged and didn't realize what had happened until to late...and they still do it. Now I can't eat because of what's going on with the machines that affect you, try and get help, no one believes you. I praise God for each day I live. Not much time left, lost 12 pounds in a little over two weeks. Court, atty, restraining orders never worked they were a joke. Two others died due to weight loss. God help abused women and children as no one else rarely does.

    I am the woman that shared this story with Tony. I just want to clarify that the other person that wrote a comment about 'machines' and is NOT the same person that this article is about.

    I am so sorry to her for suffering from whatever abuse and bad situation she believes that she has endured and I won't pass judgements on her comments. Obviously she needs to reach out for help. However, I want to make it clear, we are not the same person.

    Secondarily, I am glad to see the discussion going about this topic, whether you agree with me, believe me, support me, or hate me.. awareness is what I was wanting to have happen.

    To the woman this article is about - I applaud you. To have the courage to stand up and share her story KNOWING that she would continue to be verbally accused, degraded, made fun of, shamed, and not taken seriously - that's strength.

    I also want to point out that obviously this is not your white-trash toothless pregnant woman the media usually shows as a victim of abuse. You can see by her comments that she is intelligent and strong and tired of being let down by everyone that was supposed to protect her - her husband, the police, and the justice system.

    Tony - I wish you will start a fund and keep this topic going on your page. I would love to donate to help her out and I'm sure other caring citizens would as well. We always act like there is nothing we can do to help, but here we are staring an opportunity in the face.

The "judge" lived in a $160,000 house when he was a lowly assistant prosecutor, and actually I think it was more like $210,000, and if his kids were going to preschool then it had to be a good 5-7 years ago. It's easy enough to verify, his tax records are on the Jackson County website. But his kids now go to private school (go figure) he only used the Kansas city public school for free daycare like the other low lifes that come from all over the metro to steal a free Montessori education from deserving tax paying families in the district. I don't feel sorry for him at all. I heard terrible things about him when I worked for probation and parole. I hope this woman gets relief from another judge.

  49. I am not an attorney, but I have had experience in both the Jackson County Courts and the Johnson County Courts.
    I have seen judges in Jackson absolutely bully and insult citizens with no good reason. One case I attended was over a restraining order in Johnson County that the husband had violated in Jackson County. As a matter of fact, he was in the Jackson County jail for repeatedly violating a restraining order.
    He wrote the judge from jail to claim his innocence and her guilt for removing items belonging to their children after his arrest. The judge actually let him get away with it. He almost sentenced her to jail.
    The Johnson County court system is much more affable, even to the violating spouse. I have never seen the behavior in Olathe that I saw in Johnson County.
