TKC BREAKING NEWS!!! CLAY CHASTAIN CONTINUES ELECTION CRUSADE AGAINST KANSAS CITY MAYOR SLY JAMES!!!



TKC NOTE: Here's the latest from Clay Chastain with a quote calling out one of KC's most powerful lawyers and presenting an EPIC document intended to continue his late-tax-pay argument against Kansas City Mayor Sly James. Check it:

Chastain's attorney files appeal . . .

Elbert Walton, attorney for Lee and Chastain, filed a 59-page legal masterpiece in the Court of Appeals (See attachment) that towers over Judge Fahnestock's poorly-reasoned opinion, upholds the public interest, and puts James' mayoral hopes on the ropes.

* James was delinquent on paying his 2014 city taxes on the last day for candidates to file-in direct violation of Missouri State Statute RSMo 75.001, the intent of the city's charter, and the public interest.

Meanwhile, James' attorney, Patrick McInerney, (not to mention the woman who recently claimed (after 21 years and right before Judge Fahnestock ruled) I had lured her to my house to sexually assault her) continued his own efforts to make me look sinister before the eyes of the judges....

1. McInerney howled to Judge Fahnestock that I was, "trying to hijack the results of a city election."

2. McInerney sent me a direct communication (without my attorney's consent) informing me he was moving to file a motion for damages because he NOW believes I don't have a right to appeal because my lawsuit is "wholly frivolous." (Note: Read our appeal and decide if you think our lawsuit wholly frivolous)

Mr. Bully Boy, in full strut, then pontificated, "the real goal of your (Chastain) efforts is to deplete the personal resources of Mayor James...(with) your rejected claims."

No Mr. McInerney, my real goal is to oust from office a sorry mayor and replace him with a good mayor...either Vincent Lee or myself.

McInerney's contrived episodes of legal misconduct are designed to unduly influence the judges into thinking our case wholly frivolous and my motives wholly underhanded.

The people ache for a court that will finally stand up for the law and the public interest against a powerful mayor, and his big shot attorney, who neither play fair or by the rules.

  7. And the vast majority of folks in the metro who again thank their stars that they don't live in KCMO watch in disbelief and amusement as the Paris on the Plains, the innovation capital of the country, and the arts center of the world behaves like an elementary school social club.

    And 4:59? The term you are groping for is "ad hominem," not "straw-man." You'd know that if you had a functioning brain.

    And yes, it would be quite ironic for a Chastain fanboy to accuse others of "ad hominem" after reading that screed.

    But then nobody ever accused Chastain of logic and consistency.

  16. Hang in there Clay....you have more supporters than you think. Get SLY OUT of office - his sell out to big business is not moving KC forward and if he stays in KCMO will look like downtown KCK. Jackson County taxpayers cannot afford to have SLie as the mayor anymore - pay for a 800 room hotel? P&L ongoing TIF? Sports Complex renovation? its too much of a tax burden and now talk to eliminate the E tax? KC residents are so screwed and they don't even realize how bad it is and how much they are paying. Bend over and grab them ankles because we will continue to be screwed by the few families who run this city.

    And they're both free!
    When will the wailing about KCMO providing all the amenities and the Johnson County people taking advantage of them?
    Just ask yourself, if KCMO city government was a business, would you voluntarily invest in it?

  18. 6:15 I agree, Sly should go, but to say Clay has supporters worries me. He's been a pain in the taxpayers ass for years. While he may have a point and a legal one, I, for one don't want him in office......I think he's nuts, but even nuts win 1 once in a while.

    Let's just hope he doesn't win elected office in Missouri!

    Mayor 'Sly' (fitting nomenclature) is not above summons and this Clay is tossing $$$ at us--grab it!

  22. Appellant's brief makes perfect sense to me. It appears the allegations hurled at the trial judge is Abuse of Discretion, which means that the trial judge erroneously declared the law, its determination is against the weight of the evidence - especially because City did not file an Answer, Mo. R. Civ. Proc. 55.09. That's not nonsense that's the law. If all the City got on the record was some lame motions to dismiss - which every lawyer in town produces whether legitimate or not - I cannot see why this brief shouldn't be given the attention it deserves... other than the Mo. Ct. of App. WD is equally corrupt as the Jackson County Circuit.

    Dismissal for failure to state a claim cannot be held if Clay's petition states ANY claim that could be adopted as part of his petition. That's a low bar to jump through - but I haven't seen Clay's petition.

    At one time Kansas City was a great place to live and was also a safe place to live. Now it is almost a cheap remake of Planet Of The Apes. Its not far in our future till the top 20 feet of the Liberty Memorial are sticking out of the sand.

  25. @6:15 pm Downtown KCK has big plans for improvement- -Rev. Mayor Mark promises a healthy initiative- -a grocery and walk trail near community gardens and expanded YMCA.
    The eco devo is long awaited and the jobs are urgently needed.
    EPA's LEED cert. bldg. still empty- -wtf?!

  27. @11:49 KCK has vacant homes and low property values. He may have big plans but he will not have the tax dollars to support his vision. Downtown KCK and the surrounding blocks are mid to low income areas who are barely surviving.

    Yep, the EPA's LEED cert bldg still sits vacant with no potential owner. Its going to be hard to attract a new tenant because downtown KCK has nothing to offer. No offense but some of the 'authentic' Mexican restaurants are tasteless. KCK has an issue of longevity because a business may go in but they will not stay for any significant amount of time.
