The fight for a higher wage in Kansas City, Missouri continues to meet with increased opposition and now biz leaders are going after the beleaguered city legal department.

To wit . . .

KANSAS CITY BIZ LEADERS THINK THEY CAN BEAT CITY HALL IN A LEGAL CHALLENGE OVER A NEW MINIMUM WAGE UNDER DISCUSSION!!!

Meanwhile, Mayor Sly is organizing a pointless meeting mostly intended to mislead and condescend to the plebs hoping to make more money . . .

Minimum Wage Stakeholder Group to Meet Monday

Now, here's the bit of language from new-ish Missouri legislation that Kansas City biz leaders believe Mayor Sly, City Council and the legal department are misreading:

"The provisions of this subsection shall not preempt any state law or local minimum wage ordinance requirement in effect on August 28, 2015."

Mayor Sly and Council dude Jermaine Reed might be misleading local advocates by focusing on what City Legal says is the "local" loophole.

Meanwhile . . . Biz leaders read it this way:

"The provisions of this subsection SHALL NOT PREEMPT ANY STATE LAW or local minimum wage ordinance requirement in effect on August 28, 2015."

Remember, "It is ALREADY against state law to require a minimum wage above the state's minimum wage."

Now, there's a "living wage" loophole but that's non-binding according to some local biz insiders kind enough to serve up this tasty tidbit . . . Translation: This could all be a song and dance over a glorified resolution disguised as an ordinance with no real power to raise wages.

However . . .

WHAT'S IMPORTANT HERE IS THAT CITY LEGAL ALWAYS STAYS LOSING AND BACKS DOWN FROM A CHALLENGE . . . BIZ LEADERS SHAKING THEIR FIST AT MAYOR, COUNCIL CITY HALL SHOULD PROVIDE A MOMENT OF PAUSE!!!

Finally . . .

What our blog community fears is many broke-ass people getting their hopes up and providing an opportunity for politicos to takeover or co-opt their platform for an increased standard of living.

Also, the cruel capitalist reality is that there's no future in getting paid the MINIMUM on any scale and the real struggle is for each individual worker to compete against colleagues for more resources . . . Fair or unfair.

  6. This would also require a wage increase for a large portion of city employees. That would destroy the city budget which calls for a wage freeze. Also all bargaining contracts have a me too clause which would give across the board raises. Sly knows it is illegal and won't stand up so he can grandstand and pander saying i tried but the big bad state stopped me,.

  9. Myth Busting: Most of the people receiving SNAP benefits are white, & most of them have jobs. Wal-Mart was embarrassed that so many of their employees qualified for anti-poverty assistance. When they raised their employees' wages, they knew they would get some of it back because their employees also shop at Wal-Mart. I guess these local business men don't have such scruples, or such understanding of basic economics.

    Isn't the success of our business men supposed to result in some benefits "trickling down" to the poor masses? Isn't this the reason that they have been encouraged to accumulate wealth at unprecedented levels? Do I have to keep calling them "job creators", or can I call them "wage enslavers" instead?

    The current law reflects the current ignorance. Wrong headed laws can, & should, be changed. They are not carved in stone.

Where I work we had to take a pay cut when the new owners took over, our pay went down, so instead of making over $15.00 an hour, pay dropped to a little over &13.00 an hour, my pay is going back up little by little, but when they cut our pay, all the niggers ran to the administrators office so they could get a letter of proof their pay went down, all the niggers are on section ape and food stamps, subsidised niglet care, even at $13.00 an hour, so any pay increase will never be enough for the niggers, these niggers also get $6000.00 back at tax time. any new workers start at min wage.

    67.1571. No municipality as defined in section 1, paragraph 2, subsection (9) shall establish, mandate or otherwise require a minimum wage that exceeds the state minimum wage.

    (L. 1998 H.B. 1636 § 18)

    This is currently on the books, and is not dependent on HB 722. The city will be facing a legal battle for sure.

    I have yet to see anyone state the obvious.

    It is not against the minimum wage law for any employer to pay more than the minimum wage. Period.

    However in order to get paid more than the minimum wage you have to provide value above that level to the employer. Most people who are on MW don't meet that test.

    Some employers are ass-wipes and fall back on MW even though they may have good hard working employees. If they want to always be known as A-W's you can't legislate that away.
