Again, KICK-ASS KANSAS CITY LEGAL INSIDERS know that THERE'S NO SUCH THING AS A SLAM DUNK INSIDE THE COURTHOUSE . . . Moreover, juries and judges in Jackson County are capable of anything. The charges facing Brandon Howell are extensive but some argue that Mean Jean might be playing a dangerous game with AN AGGRESSIVE PROSECUTION that could backfire.
It wouldn't be hard to argue against premeditation in this case given that horrific nature of tragic circumstances surrounding afternoon rampage that doesn't seem to follow any logic, rhyme or reason. Also, we've heard more than a few police at the scene mention something about PCP and even worse substances that are going to be name checked in a trial. None of this explains away any of the charges but it certainly puts the crime into a different perceptive.
Moreover, Jackson County demographics and the typically liberal/progressive reputation of the Courthouse present more challenges to the prosecution. There is also a growing resistance to the death penalty in Missouri that will loom over any Murder 1 case. Add that to the increasingly incendiary racially divisive rhetoric that's surrounding this trial and it becomes far more likely that a Murder 1 charge could fall through.
Accordingly . . .
TKC TALKED TO JACKSON COUNTY INSIDERS AND THEY'RE CONFIDENT ABOUT EARNING MURDER 1 CONVICTIONS!!!
On the topic of PCP and other substances that might come up in this case . . . They compare the that argument to drunk driving cases wherein motorists are still accountable for their actions despite their level of intoxication.
JaxCo Insiders also note that the Murder 1 charge isn't mutually exclusive. Juries can be "instructed down" and if a Murder 1 charge falls through, Murder in the 2nd degree is still on the table without a new trial. Moreover, the prosecution can change the charge up until the last minute.
And so, TKC asked if the JaxCo Insiders if there's a chance that the case against Brandon Howell could be reclassified as a less glamorous but far safer Murder 2 case. The Courthouse Insider said, "There's always a possibility but we feel confident that Jean's prosecution will end in Murder 1 convictions at the end of the trial."
Confidence is important but as the debate over this case progresses, it's also critical to note that there's a very real downside in this case for Mean Jean. If she doesn't earn Murder 1 convictions and maybe even a death penalty judgement, there are more than a few Kansas City politicos and lawyer who will claim that she failed and will continue to argue that she's soft on crime.

The jury didn't think there was adequate evidence...remember that in the US defendants have the right to due process and are innocent until proven guilty. My client went to the home to inquire about the Jaguar automobile. While there, he was verbally attacked with racist language, physically attacked and injected with unknown drugs which altered his normally passive demeanor. The next thing my client remembers, he was walking along the highway in search of law enforcement to report the crime which had been committed against him.
After the charges against my client are dropped, we plan to file a wrongful prosecution against all parties involved. And you know how quick KCMO is to settle cases out-of-court for big dollars!

I appreciate that others have different opinions, and I am really sorry if I sounded arrogant. I just think that it is important that we all take a breath and think about what happens next. Families are grieving and people are upset, but we still have to think about the rights of the defendant. We can't be putting people in wood chippers! That would be murder too! I am in school for a paralegal degree and plan to do mitigation research to help death row inmates who are victims of our racist legal system....so maybe that biases me in a different direction from others on here.
