Here is the pic Sherwood is using that is being referenced in labor circles of uniform KCPD officers and Emergency Personnel. This is a huge mistake by Sherwood's campaign because it has potentially put the jobs of these uniformed men and women on the line since state law prohibits Kansas city uniformed officers and emergency personnel from being on literature or promoting a candidate or party.

Here is the bill that went into effect at the end of August 2013

Penalty is termination, loss of retirement, fine of up to $500 and even up to 6 months in jail.

There is even talk that endorsements would have to be pulled if brought out in public.

  3. The issue is not about the campaign material. All any of the folks in the photo have to say is they did not consent top the use of their likeness and case closed. Where the question lies is whether the folks in that photo were campaigning when they posed behind Smith. I think the state law requires more than their presence at an event. So good luck finding a violation. I ain't saying it is right....I'm just sayin' it ain't no crime whet these folks did.

  5. It's not even close to a Hatch Act violation. The picture was not from a political function, but a public safety event way prior to the candidate's announcement. Both departments could request the picture be replaced, but in no way could any individual employee be held responsible for the use of their likeness. Get your facts straight, and learn the law.

  6. Agree that this is not a violation of any law. However, it shows Mr. Smith's extreme lack of political skill, or worse, disregard for those pictured. The photo is positioned in the context of a political message, inferring everyone pictured is supporting him politically. His political operatives should know better, but they're a pretty naive bunch.

Under this act, those activities are only prohibited while the officer or employee is on duty or in uniform.

The photo was taken in July of 2009 as the Governor signed HB 580. Anyone could have found it with just a little work. He hasn't been campaigning for 5 years.

  18. sounds like a hit piece to me. the only uniformed officer is clearly there to guard the guy giving the speech and only KC is visible behind him.

    The campaign poster also seems to be well written, rational, centrist and not at all misspelled.

    I noticed nearly everybody who is anybody has endorsed Smith. Don't know much about the guy but he seems on the up and up if this is all they can complain about.
