I just recently sat down with Unified Government Commissioner Tarence Maddox. I knew he would be under alot of pressure once Commissioner Barnes was no longer there with him. After sitting and talking to him for over two hours what he explained to me was just sad and terrible. I want all who are attached to know that I follow Commissioner Maddox's efforts. I admire what he has done and is doing, and yes I'm an advocate for him. In all of my years living here in WYCO I have never seen a young man his age of 31 bring people together, put on events and get other young adults involved. When I seen the recent 41 story it just didn't seem right to me. 41 has now lead two stories on this young man. It seems as though they are targeting Commissioner Maddox, AND I WILL NOT JUST SIT BACK AND LET THIS HAPPEN. There are are all types of news worthy inequalities happening here in Wyandotte. Maddox told me many of these slanderous stories are coming from City Hall in the ethics department. He told me of a personal conflict with him and the County A#d#t0r.

Maddox told me ########## is vindictively sending stories to 41 whenever there is a ethics complaint filed . . . I ask that you join me in support of Commissioner Maddox, many of us who have been here for years know that if Maddox wasn't doing something right he wouldn't be under this type of pressure from the CURRENT -MACHINE- system in place. WE MUST STAND BEHIND THIS YOUNG MAN AND NOT LEAVE HIM HANGING.

Comm. Maddox will be presenting to the Ethics Commission next Thursday at 4pm. We community supporters have agreed to be there in support we asked that you join us (THURSDAY MARCH 13TH 4PM, COUNTY COURTHOUSE 2ND FLOOR -OLD COMMISSION CHAMBERS) We will be sending a clear message to City Hall that we are sick and tired of being SICK AND TIRED . . . Commissioner Maddox is a native of Northeast WYCO he's our native son and we must protect him in that manner and make sure he has the chance to blossom. He's young vibrant, charismatic, strong, and demanding, they know that in City Hall and their trying to kill his spirit. Lastly Comm. Maddox has put on various events reengaging citizens in Wyandotte. He has appropriated funding for Freedom Schools this Summer for our youth. He has created a Coalition of Citizens against crime etc...... Commissioner T has the best interest of the Northeast at heart. He's dependable, he's always serving others in some capacity and that's what we need in a Commissioner. Commissioner Maddox also has a family that the media and certain folks are disrespecting. WE SHOULD NOT ALLOW THIS...... think about it IT'S NOT RIGHT join us next THURSDAY mark your calendars now MARCH 13TH 4PM 2ND FLOOR OF THE COURT HOUSE. I asked Commissioner Tarence Maddox to write down what he told me about the gas station incident, and he emailed me the statement he gave to the Ethics Department, Mayor and Commissioners read it for yourself. As I have sent this out in mass emails and everywhere abroad even to Washington D.C, I thought you should have a copy and explanation. We just can't function this way. It is my firm belief that there are people in City Hall fueling this ignorance and I wanted you to know the real story. Thank you for your time in reading!

I hope that this email reaches you in good spirit. The last 72 hours have been a fiasco. Here in the KCK area, groups have been forming to form boycotts and also issue petitions and I am at the center of this current issue. As I understand there are numerous investigations taking place, I am taking the initiative to give the story in its entirety. As I have met with various support groups over the weekend I have also submitted this same information along with documents for their records. Many citizens are irritated and on the edge as 41 Action News has run its latest slanderous story on me. After I am done I hope that you have the information needed to enhance your investigation so this will be handled properly.


On the morning of January 8th at approximately 7:20 am I entered the BP gas station at 900 N 5th St. Upon entering the store, the store appeared in disarray as the length of the line reached the back of the store. I noticed a worker that seemed as if he was confused and was suffering from some sort of medical condition. I witnessed him unplug the register twice and restart it. As a result, after about 15 minutes the line grew out of the store. Tension was high because every time the worker unplugged the register the customers who were pumping gas outside pumps would freeze. While I was inside of the store I witnessed people come in, angrily, and ask for their refund. As I proceeded to the register I had hoped my luck would be better because my vehicle was low on gas and I could not afford to risk traveling to another gas station. I asked for $20.00 on pump 1 and slid my card and after a successful transaction the worker then gave me a receipt. As I went to pump my gas I watched 2 customers, angrily, re-enter the store as their pumps had frozen once more. Upon reaching my pump and attempting to pump gas, my pump did not pump the gas I had purchased. As I re-entered the store to rectify the problem, the store was in pandemonium, with everything from spit spats to arguments. When it was my turn again I told the store worker the gas did not pump, he said, "I don't know what the problem is all we can do is try the transaction again." So I swiped my card AGAIN and to shorten the length of this story it happened a total of 4 times, after the 4th swipe the bank froze my card for fraud protection. After 45 minutes of unsuccessful transactions I drove to another pump at B.P. which I believe was pump 3. I was forced to use a credit card that I never use and I paid for gas at the pump.

As I reached my destination late I also was concerned that my card may have been charged all 4 times. On the next day January 9th I pulled up my mobile banking account to check to see if I was wrongfully charged a day earlier at the gas station. There were a total of 4 transactions and 3 had been refunded. The 4th transaction was not refunded just as I thought. On that same day Thursday Jan 9th, I re-entered the BP gas station to for my first attempt to make a claim for a refund. I asked for a claim sheet which should be substantial for any properly functioning business. I was told that a claim sheet does not exist. I then asked, "Well how could I get in contact with the owner?" I was told the owner does not give his contact info to the customers and that I Tarence should leave my information and I would receive a call back. (It doesn't take a professional of any sort to know that this is an improper procedure to handle business - every business usually has a form with a corporate number or a concerns and complaints number, but this business doesn't) Four days passed and on Jan 14th I re-entered the BP to make a purchase and also inquire about my refund. I still had not received a call from the B.P. Store Owner. This time I encountered a new a worker. Again I asked for a proper claim form to request my refund. The worker replied, "What is that?" After I explained to her what a claim form was and why it was important, she replied, "We have never had a form like that as long as I've worked there." She informed me that the owner knew about my situation, but I should leave my name and number again so that she could make sure he had my information. It was a pleasant conversation; I told her thank you and left the store. Seven days passed and I still had not received a call from the owner. I re-entered the store on a second attempt Jan 21st and this time it was the same worker as the previous visit. The female woker looked at me confused and said, "He hasn't called you yet?" I replied, "No he hasn't." She said "well he does have your name and number and he should be contacting you." I then asked the worker if there was a specific time I could come to the store while he was there and she said "we never know when he will be here he comes at different times." I guess as a part of their invalid customer service procedure she again asked for me to leave my information and this time I left her my UG Business card. This time I left the store a little disgruntled and at a loss for how I should handle the situation. Normally, I would have just let the $20.00 go as a loss but due to continuous customer neglect and the fact that I hold a position in District 4 in which the store resides. I decided I would go ahead and push the issue to see what it would take to get my refund. Nothing could be more distasteful than business owners who mistreat customers in the community in which their store operates.

Three weeks had passed and the owner had not contacted me one time about refunding my money. Six days after my last visit I believe the date was Jan 28th upon my 4th visit I encountered the same worker I had spoken to on Jan 9th. As I went to ask her more information about the owner and requested for him to call me ASAP. She replied I'm not telling him that because I might lose my job. After a few minutes of a heated exchange I left my information again for the 5th time. I proceeded to go to the drink fountain and purchase a drink. After the transaction I told the clerk thank you and left the store. (41 Reporter Kath never showed the whole transaction in the video) During this debate the clerk grew hostile with me first and said. "What else do you want me to do I have passed your information on." As a consumer who had been incorrectly mis-charged and neglected for weeks, I became frustrated. I announced who I was as a Commissioner in the community in which the business operates. I also told her that I see various code violations and infractions which are all important things to an elected official. I mentioned things to her that I knew she would mention to the owner, and not to my surprise the owner called me the next day January 29th, 3 times. I did not answer but after noticing that the unknown number called me 3 times I called back. On the other end of the phone the owner of the BP cursed me out for approximately 2 minutes, he told me I had threatened his business and he threatened to sue me. After about 5 minutes of verbal debating, he calmed down. The Owner then asked these questions: what happened? what date did it happen on? how much money was it?, and could I prove it? (All of the questions that SHOULD have been on a formal claim form) He then requested for me to bring him copies of my bank statement showing that I was over charged.
On Friday the 29th of January, I took copies of my bank statements to the BP gas station. I gave the documents to a worker and the owner did call me back on Jan 29th to tell me he had received the documents and that he would give the information to his "card guy" to investigate the charge to see if I was wrongfully charged. Five days passed and I had not received a refund or a call so I called the owner on Monday Feb 3rd and he told me that the card guy still had not gotten back with him with a definite answer; The Owner also told me he would call me once he received feedback from his card guy. On Friday Feb 7th I had not received a call from the owner so I called him back again. He told me that my card had already been refunded and that I should go check with my bank. I told him thank you and good bye. After my goodbye he told me that he had contacted the ethics commission with a complaint of my threats. I told him good bye and hung up the phone. Upon pulling up my mobile banking I did recognize that the refund had been put back in my account on Feb 5th.

There are 3 things that concern me. One, had I not mentioned my concerns about the condition of the store and the poor customer service in regards to the owner he probably would have never called me back. In the last week since 41 ran this story many people have communicated to me that they still have not been refunded for mischarges in similar situations from the same gas station. Two, after the owner recognized that I was wrongfuly mis-charged for services that I did not receive, he never communicated with me the date the $20 would be refunded. And that shows his respect for customers is lacking to say the least. Three, that there are many businesses that function on a daily basis in this chaotic manner and there needs to be a proper chain of command communicated to citizens and Commissioners as to what their rights are when being mishandled.

UNFORTUNATELY THE STORY DOESN'T END THERE:
After receiving my refund on Feb 5th and the owner verbally communicating the refund to me on Feb 7th there was no need for further communication between me and the store owner. On the morning of Feb 18th, the owner of BP gas station called me back to back and both calls came in simultaneously at 8:51AM. As I wake up at 9:00AM I abruptly called the number back thinking it is an emergency because of the simultaneous calls. To my surprise and feeling of disdain, it was the owner of the B.P. Gas Station 900 North 5th street. He was apologizing and telling me that he wanted to compensate me for his lackadaisical response and his inadequate policies as a business. He then told me he wanted me to meet him at the B.P. Gas Station so he could give me a free $50.00 gas card. I told him no that was ok and that my initial refund of $20 was enough and that he no longer needed to call my phone. I've got to admit I was irritated because something didn't seem right about the situation. After dealing with the situation for approx. one month and two weeks the owner had never attempted to meet me at the store. I couldn't understand how 12 days after my refund posted he now wanted to meet me at the store and be accommodating. This unfair wrongful mis-transaction of $20 was now being used as a scheme against me as an elected official. Kath the reporter at 41 news called me the next day February 19th telling me he was going to run a story on me. This became a scheme because someone somewhere wanted me to violate the ethics code. They wanted me to take the $50 gas card, so the report would say I violated The Prestige of Office portion of the ethics code by receiving "PERSONAL GAIN". But I turned down the $50 gas card and then the reporter Kath began calling and harassing me the next day. Why would the store owner call me 12 days after the refund posted if he felt threatened by me? There was no need for further communication. And who would believe it was a coincidence that the reporter called me the next day trying to run a story 23 days after the alleged debacle with the clerk. This has now become an organized well planned scheme against me as an elected official. The citizens in our community are very aware of it and as voters and tax payers these types of shenanigans will not be tolerated. Every claim that I have mentioned is connected to this email in attachments. I have pulled my bank statements and phone records. The date 1/8/14 when the transactions happened and 2/5/14 when the transaction was refunded are all listed in the above attachments as "screen shots".

I an elected official did not break the code of ethics Section 2 265: (a) A unified government representative shall not intentionally use the prestige of the unified government representative's office for the unified government representative's own private gain or that of another except as may be permitted under this division. (b) The performance of usual and customary constituent services, without additional compensation, does not constitute the use of the prestige of office for a unified government representative's private gain or that of another.

I will say this in short! It’s simple I did not use my title for personal GAIN. In fact I was illegally mischarged and simply requested my refund. There was nothing to gain. We don't see this as a discussion of a Commissioner wrongfully using his title for personal gain. But this is an issue about
the business B.P. Gas Station 900 N. 5th street who's current procedures are not in compliance with consumer bill of rights laws. Again the community is watching closely and we will not tolerate injustice or schemes against our votes or Elected Officials and as an entity / facilitator of the Unified Government Municipality you shouldn't either.
