ReplyDeleteThe autopsy was supposed to take 4 to 6 weeks so they know what killed him. Was it blint force trauma, a heart condition? Acute alcohol poisoning? Probably makes a difference between a manslaughter charge or something else.

ReplyDeleteFolks the autopsy is done, they know the guy was beaten to death. Since you can't beat yourself to death, the death was ruled a homicide.
ReplyDeleteWhat takes several weeks are the toxicology reports. Defense lawyers want to know if the victim contributed to his own demise by being drunk or high.
Remember Judge a John Torrance? He gave that drunk, under 21 white kid who ran over a guy and killed him (then left the scene and ditched the car) only 30 days "shock time" because the poor guy who was killed was drunk. The drunk guy who made the decision to not drive drunk was run over and killed, while the rich white kid from Mission Hills with a lawyer for a mama drives drunk AND underage, hits the walker and kills him. Then he gets off with a 30 day sentence.
Van Winkle's killers will most likely not even be charged. Remember, it's Jackson County.
