Taking licenses away is a perfectly reasonable solution to drivers who won't comply with a breath test . . .

When you sign for your driver's license you sign consent to a blood draw. You signed your blood hoarding liberties away in order to drive.

I can kind of understand DUI Checkpoints, thought I disagree with them. I do not understand how this is acceptable.
The police act with the approval of the public. Robert Peel, one of the fathers of policing, laid this out in his nine fundamental principals. This is absurdly inappropriate.

Read the numbers in the paper. Every time, it's a couple 100 pulled over, and only a couple arrests.
It says refusal to take a breath test, OR blood test.
I think giving the govt. carte blanche to take your blood, through fiat or law is nuts and I am a libertarian conservative.

The officers have to obtain a warrant first...same as they always have! This isn't a case of "get pulled over- automatically give blood". It only applies if you've been drinking and driving, AND you refuse a breath-test. You consented to the breath test when you decided to drive- drunk or sober.
Nothing's changed- just that the police are pursuing their legal options. And if you're driving drunk, in my opinion- you deserve whatever you get.

Sixteen other states have similar laws making it a crime to refuse a blood alcohol test.
Starting in July, 2012, the penalty for refusing a breathalyzer will be the same as if you are convicted for a DUI.
The new law is misguided because of the current penalties for refusing the breath test are already extremely severe.
Refuse the breath test in Kansas, already before this new law they would get a one year suspension followed by one year of ignition interlock even on a first offense
Prosecutors point out those who refuse to blow often avoid a conviction and still drive on a suspended license.
They may not have a license but that’s not stopping them from going out and drinking and driving
First time offenders can still refuse the breathalyzer without facing a criminal penalty but the second time you’re pulled over, if you refuse to blow, you’ve basically already convicted yourself of a DUI.

A few of these comments come close. Driving isn't a right.
I feel that when you apply the rule of "someone who has been previously convicted of DUI" there shouldn't be any qualms over this. If you've already proven that you are incapable of handling yourself as a safe functioning member of society, then you better damn well prove that you deserve to be behind the wheel of a 2,000+ pound machine that barrels down the road.
And what if you are not drunk, but have a medical condition. I believe there was a story, last year, where some diabetic died in police custody at a traffic stop, like one of those waiting on the medical supena. excuse the spelling. So you folks are willing for more non-drunken drivers to get poked by dirty needles, remember police budgets, by non-medical personal, remember hospital budgets, just to get a supposed drunk driver off the road. Remember they are violating your rights of free travel, of access to your medical supplies, just because they can. And there are medical conditions that appear to the non-medical as drunkenness. Such as diabetes, some medications you may take appear as alchol byproducts in the blood. Some foods such as poppy seed muffins appear in your blood as pot,pcp, and speed.
Remember you can be arrested for those. And now you have to prove you are innocent, not them prove you are guilty. Thats how the laws are now.

The law very clearly states only trained medical staff can draw the blood.
Plus anyone who has a medical condition so severe to cause conditions as possible drunkness they need to have medical alert necklace or braclets on them.
While poppy seeds might show up in a test they sure not going to make you drunk.
Simple solution to the whole issue is don't drink and drive. Then nobody will be sticking you with needles.
And if you live in Kansas you best read the laws very well before you go get your drivers lic renewed because if you don't like them then I suggest you don't get one or at least get off your ass and start a grass roots protest group to ty and change it all. But doubt you will do so.
Life is just plain bizarre. It’s hard enough earning a living and making our way in the world, without failing mandatory drug tests when you haven’t done any drugs to warrant the result. I’m talking about eating poppy seeds and hemp foods. Yes, they can indeed cause you to fail a drug test. This does not happen often, but it does in fact occur from time to time.
Most people who eat poppy seed bagels will not fail opiate tests. And most people who eat hemp foods will not fail marijuana tests. This is due to the incredibly low volume of psychoactive compounds fond in these foods. But occasionally somebody will fail a drug tests when they have done no drugs at all, and this can be due to eating commonly available foods, like a poppy seed bagel or a hemp seed energy bar.
I personally believe that we live in an alarmist time when drug testing is way out of hand. But that is not the issue here. If you eat poppy seeds or hemp snacks, you may possibly fail a drug tests. If this happens, you may lose your job. This is unfair in any case, but you will have to do some fighting to rectify things.
