ReplyDeleteIf you feel the need to insult an elected official the first amendment protects your opinion about them so long as your comment doesnt attribute anything to them. Example. Ok to say someone is a jackass, not ok to say someone said, wrote or otherwise did anything to the jackass. Subtle difference for sure but an important one in court.

It is defamation to say an elected offical IS a murdered or a philanderer or a deadbeat dad unless you are willing to present evidence in court using truth as a defense. You are correct that an opinion of assessment is protected. You can say someone is a dumbass or dresses like a bafoon.

Just because we know who your talking about does not give them grounds for a defamation suit. Had you used her name she actually could sue tkc for the ip address then sue the server for a name and then either file a defamation suit in civil court for emotional damages or file criminal charges of harrassment with the kcpd.
You are not as annonymous as you think and in the after math of gabby giffords i bet a cyber defamation bill making it easier to obtain that info has a chance of passing. Its a brave new world.
