Recently, I talked with a local Latino who recently visited Arizona. He is an American Citizen, born and raised in this county and an older guy who drives a car adorned with Jayhawk stickers . . . His recent trip to Arizona featured NOTHING BUT HARASSMENT FROM AUTHORITIES THAT HE SUSPECTED WAS MOSTLY DUE TO HIS SKIN COLOR!!!

A recent presser from the local branch of the ACLU speaks to this common occurrence that might ramp up during the upcoming 4th of July weekend.

Arizona Racial Profiling Law Threatens Civil Liberties

Kansas City, Mo. – In response to civil liberties threats caused by the recent passage of Arizona’s racial profiling law, the American Civil Liberties Union of Kansas and Western Missouri (ACLU) issued a travel alert today informing Kansas and Missouri residents of their rights when stopped by law enforcement if traveling in Arizona. The unconstitutional law, known as SB 1070, requires law enforcement agents to demand "papers" from people they stop who they suspect are not authorized to be in the United States. If individuals are unable to prove to officers that they are permitted to be in the U.S., they may be subject to warrantless arrest without any probable cause that they have committed a crime.

Although the law is not scheduled to go into effect until July 29, the ACLU is concerned that some law enforcement officers are already beginning to act on provisions of the law. Moreover, there has been a history of rampant racial profiling by law enforcement in Arizona, especially in Maricopa County, as well as a stated anti-immigrant policy of “attrition through enforcement” by Arizona lawmakers meant to create a hostile enough environment for Latinos and other people of color that they voluntarily leave the state.

“It is imperative that Kansas and Missouri residents understand their rights before traveling in Arizona,” said Dan Winter, Executive Director of the ACLU of Kansas and Western Missouri. “Under this new law, for simply looking ‘foreign’, you are more likely to be stopped by police for minor infractions like having a broken taillight or jaywalking and then asked to prove you are in this country lawfully.”

In addition to the travel alert, the ACLU has made available in English and Spanish materials on individuals’ rights if stopped by law enforcement in Arizona or other states as a result of SB 1070 or for any other reason. The materials include a downloadable card with instructions – applicable in any state – on coping with vehicle stops and questioning by police, U.S. Immigration and Customs Enforcement agents or the FBI, as well as a Frequently Asked Questions document about SB 1070.

“Our goal is to protect Kansas and Missouri residents from illegal harassment by law enforcement and to make sure they know their rights should they encounter it,” said Winter. “It is time Americans recognize that constitutionally protected rights to freedom of speech, a fair trial, due process, and many more are not just limited to citizens; they apply to all people in this country, including immigrants.”

    we are guaranteed free speech in this country according to the U.S. Constitution - but we have it in actuality only because of organizations such as the ACLU.

    playboy magazine has had some great free-speech lawsuits over the years, and WON them with the help of the ACLU.

  11. I will believe this report when I see the law suit for civil rights violations by the people that Tony is talking about. The one thing that people need to understand about Blogs is that there is NO FACT CHECKING. I find it hard to believe that the police in Arizona, with all the attention that they are getting, are harassing Hispanics simply for the color of their skin.

    Now, make a target of yourself, and all bets are off. I am willing to be that this is nothing more than a case of complete bullshit.

But the sentiment—disdain for law enforcement and the rule of law—is clear. And it happens to be the same sentiment behind the kneejerk opposition to the Arizona immigration law, which this week may elicit a legal challenge from the Justice Department.

    In this, the authors of the law were clever. They knew their law was no solution to the federal government's failures on immigration. They also knew—perhaps hoped—that the law would be challenged constitutionally, and that this challenge would likely end up in the Supreme Court.

    But they knew something else: By writing it the way they did, they would smoke out the "no badges" brigade—those who effectively oppose real enforcement of any immigration law.

  13. That's because at its core, the Arizona law adds nothing to immigration law. To the contrary, it empowers Arizona police to do their part to uphold that law when they have a "reasonable suspicion" that someone whom they've stopped for some other law enforcement reason is in the country illegally. On top of this, legislators added language to prohibit using racial profiling to make such a stop.

    The response has been illuminating. In Mexico, President Felipe Calderón declared that the Arizona law opened the door to "intolerance, hate, discrimination and abuse in law enforcement." In the ranks of Congress, members variously invoked—take your pick—"Jim Crow," "apartheid" and "Nazi Germany."

They are not racial profiling in AZ anymore than what you see in any other state. the AZ police are simply allowed to enforce a law that has been on the books for ages. chances are your state has a similar law but the cops are banned from enforcing it. I don't understand why it is a bad thing to question citizenship status when probable cause exists. They don't get pulled over for being brown but when they are questioned they are bound by law to be truthful, lying to the police is a crime too ;)
